Terms of Participation and Privacy Statement

Aim and scope

Business Insights Gallery (BIG) provides a space for looking, thinking and contributing. These Terms of Participation and Privacy Statement apply to the website at havelant.co.nz, public submissions, selected perspectives, reactions and related contact with the curator.

Definitions

“BIG”, “we”, “us” and “our” mean Business Insights Gallery and its curator, Kinga Havelant. “You” means a visitor, contributor or person making a report. A “Contribution” is text, attribution details, links or other material submitted to BIG. A “Perspective” is a Contribution selected, edited or displayed by the curator.

Eligibility and acceptance

By submitting a Contribution, you confirm that you are at least 18 years old, have legal capacity to agree to these terms, and have read and accepted both these Terms of Participation and Privacy Statement and the Content Complaints and Removal Policy.

Voluntary participation

Submitting is voluntary and unpaid. A valid email address is required so we can manage the submission, but it is not published. Your full name is collected as a private record. You may choose whether a display name and professional link can appear with a selected Perspective.

Curatorial process

BIG is curated, not voted on. The curator may select, hold, decline, archive or remove a Contribution at their discretion. Selection is subjective and does not imply endorsement, professional qualification or agreement.

We may make discreet editorial, spelling, formatting or length edits. We will not materially change the meaning without seeking permission where reasonably practicable. BIG does not operate public votes, follower counts, reply threads or ranking systems.

Identity and connection choices

If a Contribution is selected, it may be displayed anonymously unless you give permission for your display name to appear. A professional descriptor or link is only displayed when the relevant permission has been given. Optional contact or social details are never required to participate.

Ownership and licence

You retain ownership of your Contribution. By submitting it, you grant BIG a non-exclusive, worldwide, royalty-free licence to store, review, moderate, edit as permitted, publish a selected Perspective on the website, archive it, provide it to necessary service providers, and use it for BIG promotion only where that use is reasonably connected to the gallery and authorised by your choices.

This licence does not permit us to sell your Contribution as a standalone work or use it to train, fine-tune or evaluate an artificial intelligence or machine-learning model. The licence ends for future publication when a valid removal request is accepted, subject to backups, records and legal obligations.

Your responsibilities

You confirm that your Contribution is genuinely your own work or that you have all permissions needed to submit it and grant the licence above. You must not submit confidential, private or sensitive information about another person without authority. Any factual claims should be honestly held and reasonably supported.

Unacceptable content

Do not submit content that is unlawful, threatening, harassing, hateful, discriminatory, sexually exploitative, defamatory, deceptive, invasive of privacy, confidential without permission, infringing of intellectual property, or intended to manipulate the gallery or harm another person. We may preserve, restrict or report content where required or permitted by New Zealand law.

Concerns, rights complaints and removal

Use the Content Complaints and Removal Policy to report copyright or other rights concerns, privacy or confidentiality issues, attribution problems, harmful digital communications, or other content concerns. A contributor may also request removal by emailing curator@havelant.co.nz. We aim to remove accepted content from the live site within 10 working days, while backups, legal records and cached copies may take longer or need to remain.

No professional advice

Perspectives are curated prompts for reflection. They are not legal, financial, medical, investment, employment, safety or other professional advice. You are responsible for deciding whether any idea is suitable for your circumstances.

BIG intellectual property

The BIG name, design, layout, original editorial writing, visual system and other gallery material belong to BIG or its licensors. You may share links to the site and use the platform’s share tools, but must not copy or commercially exploit the gallery as a whole without permission.

Privacy Statement

12.1 What we collect

We may collect your full name, display name, email address, optional professional descriptor and link, Contribution text, permission choices, moderation history, reactions, report details and technical information needed to operate and protect the service.

12.2 Why we collect it

We use information to receive and manage Contributions, contact contributors, moderate and publish selected Perspectives, apply permissions, process reactions, respond to reports and rights requests, maintain security, improve the service and comply with law.

12.3 What is public

We do not automatically publish a Contribution. If selected, the Perspective text and permitted attribution may appear publicly. Full name and email are private curator records and are not displayed as public attribution.

12.4 Service providers and overseas handling

We may use hosting, database, storage, email, security, analytics or other service providers. Some providers may process information outside New Zealand. We take reasonable steps to select and manage providers appropriately and only disclose information for a lawful, necessary purpose.

12.5 Your choices and rights

You may ask for access to or correction of personal information, withdraw optional publication permission, or request removal by contacting the Privacy Officer. We may need to verify your identity and may retain a limited record of the request.

12.6 Sensitive and third-party information

Please do not include sensitive personal information or information about another person unless it is necessary and you have authority. If you think a Contribution contains someone else’s information, report it promptly.

12.7 Retention

Active submissions and associated contact details are kept while they are being reviewed or published. Unselected or declined submissions and unnecessary personal information are reviewed periodically and ordinarily deleted or anonymised within 12 months after the last relevant action. Published Contributions remain while published, subject to removal requests. Complaint, consent and legal records are kept only as reasonably necessary to resolve matters, establish or defend rights, or comply with law.

Availability and liability

BIG is provided free of charge and on an “as available” basis. We do not promise uninterrupted availability, that every Contribution will be retained, or that the website will be error-free. To the extent permitted by law, BIG is not liable for indirect loss arising from use of the service. Nothing in these terms excludes rights or remedies that cannot lawfully be excluded.

Free access

There is no charge to view the gallery or submit a Contribution. We may change, pause or close features without owing payment or compensation.

Changes to these terms

We may update these terms when the gallery, law or operating practices change. The current version and effective date will be published on this page. If a change materially affects an already submitted Contribution, we will take reasonable steps to communicate it where appropriate.

New Zealand law

These terms are governed by New Zealand law. The parties submit to the courts of New Zealand, subject to any mandatory rights or processes that apply.

General

If part of these terms is unenforceable, the rest remains in effect. Rights that are intended to continue, including privacy, intellectual property, licence, complaint and liability provisions, survive closure or removal of a Contribution. A failure to enforce a provision is not a waiver. We may transfer or restructure the service as part of the gallery’s operation, provided this does not remove your mandatory rights.

Before sending a public perspective, the submission form requires both confirmations below. The optional publication permissions are separate and can remain unchecked.
